Hi Steph,
is TOU still supported? It seems not to work on 3.x and there is no comment from you on this forum since 2010/10/22 ?!
Do you still support this great plugin?
Will we see a new version for WP 3.1? Will you support POT files?

I haven't really been supporting for several reasons:
1. I didn't originallu author this plugin. It's actually a modified version of this one:

The code is very disorganized and messy, and it drives me crazy to look at it. If this plugin were to continue, I would have to completely rewrite it in order to handle working on it.
2. In order to rewrite it, I would need to invest a large chunk of time. Unfortunately, this time would give VERY little return on investment, so I find my time better spent on other ventures.
My time will be opening up a little in the next month or two, so it's possible I would put other work on hold for a bit in order to rewrite this plugin. However, if I were to do so, I would probably need to put a price on it in order to make it worth the time to maintain it. So I guess this plugin ends up between a rock and a hard place…. Maybe the question is if this were a (functional) commercial plugin, would you pay for it? And if so, what price tag would you put on it?

A commercial plugin is OK for me. Good work should be get paid 
What about $25,- and $12,50 for a yearly subscription?
Would this be an option to refactor the plugin?
What price do you have in mind?

I am in the process of rewriting this plugin. It will be an update to this plugin and will remain free. It will integrate with Formidable, and then hopefully upsell to Formidable Pro. I think the first part of April is about right for this heavily modified release.

I think your work will be get paid for you.
Within Germany (and I believe Austria, France etc. will follow) there's a huge discussion about privacy and how to inform users about tracking (Google Analytics, Facebook like etc.).
The discussion is about 'do you have to inform your users what your site is tracking, on the first site the users came to your homepage and are you (as the owner of the site) have to asure that every users gets this information and accept it (or redirect to an other site)'. It seems that all sites within Germany have to do this in the next months or earlier.
So you should promote your 'new' plugin as a way that it can be used to achieve compliance with the new German privacy protection laws.
For a Pro version and about 360.000 German WordPress installations not bad…

It's started, but still in the heavy development phase and not fit for testing yet. I'm not sure on the timeline at this point. There have been a lot of other things that have been taking priority, specifically the Formidable Pro add-ons. But I think another 4 hours or so should finish it up to a testable point. If I had a sponser, it would go much faster
